Education, health care, housing have become oppressed people "three big mountains." Therefore, the issue on the fairness of education became a hot topic in academic research. Compared to the educational process and educational result, equal educational opportunity is the most important issues and outstanding basic issues at this stage. This paper analyzes the regional disparities, urban-rural gap, different the social stratum,household registration system, etc. Through all of factors affecting on the equal opportunity higher education, found the common factor is the existing dual economic and social structure. Therefore, change the opportunity presented to the Higher Education should be changed the fundamental dual economic and social structure.In this paper, adopting the method of literature analyzed dual economy, education, defined the concept of fairness; by the induction of higher education unequal enrollment status; by comparative analysis of the dual structure of the various factors on the higher education fair.The main conclusions of this paper is that, to change the existing higher education equity issues, change China's largest and complex dual economic structure and social structure, it is the actual situation. Education reform is no longer simply taken several measures. There are steps and full range of to improve the higher education fair.Through this research on enrollment in higher education, realize the higher education fair. We take the following measures: increase investment in education of rural and remote areas; adjust irrational political measures of the house hold registration system; improve the quality of primary and secondary education in the rural and remote areas; at the same time, we improve the education funding system, change the thinking of city as the center.
