Social relationship in education is becoming more and more complicated in China nowadays. Meanwhile, people's consciousness to protect their rights increased too. Lots of problems occur in university's administration. Traditional problems in administration no longer stay in the management level, but become legal argument. However, there are little studies and few practice in settlement of disputes aroused out of academic title evaluation of university teachers, which becomes a big problem for both the universities and teachers. In order to protect the legal rights and interests of teachers and promote legal and rational evaluation of universities, the paper discussed the legal nature of academic title evaluation focusing on teacher's legal rights and analysed if it can be litigated. Opinions on the relations of judicial review and university autonomy are also provided in the paper. The author believed that judicial review and university autonomy should be balanced so as to protect the legal rights and interests of both universities and teachers.
