Legal Issues On Standard Management Of Urban Pet

As the quick economic development, accelerating urbanlization process and theimproving residents’ living standards of China, the population of city pets growsrapidly. However, when the pets comfort city residents and meet their needs of innerpeace, the problems caused by pets wounding, barking, abusing and the spreading ofabusing images，along with the challenge about social security and the environmentand health issues brought by stray animals are becoming increasingly serious. What’smore realistic is that the "stop dogs on highway" events frequently happened in recentyears，which had pushed pets management to the center of public attention. Mostnormative documents about pets management in China are stipulated by localgovernments, and the management effects about pets raising, markets and treatmentbusiness are relatively indistinctive. The main problem encountered in the study ofcity pets management legislation is to improve the existing legal system，for the aimof regulating and guiding the behavior of pets owners as well as the whole marketorder. What also significant are protecting the legal rights of pets owners andpractitioners and reducing the negative effects by illegal activities.This paper mainly discusses the legislative research on city pets management.After stating the necessity of pets legislation, the applicable scope and managementsystem, the article introduces the basic situation of Chinese current pets managementon its legislation principle, institution and responsibilities. Beyond that, correspondingsuggestions are given at the time of reviewing and drawing lessons from foreignlegislation experience.First，the article states the necessity of legislation research about city petsmanagement for four reasons，guiding the pets industry economy，reducing thebehaviors of pets abusing，improving the government’s public functions and copingwith current affairs actively. Then, the paper discusses five principles to which thelegislation research should adhere, prevention of cruelty to pets, supervision of thewhole process, combination of restrictions and management, subject of liability andpublic participation and social supervision. After that, the third part is mainly aboutthe pets legislation institutions, which contains audit of qualification, pets registrationand licensing, number controlling, pets insurance, public interest litigation of pets, theroom of pets activity. Both the general domestic and foreign legislation situation areintroduced and some advice are presented. Finally, the civil, administrative andcriminal liability about pets legislation are discussed.
