In a modern society, a series of problems related to the pet including animalbites,excrement feces pollution, cruelty and protection have been paid increasingattention. In our country, the available research on the pet management is still notenough to deal with problems resulting from the pet keeping, especially, research onlegal regulation which is with great significance for the pet management is still at arelatively beginning level, and the system of regulation on the pet keeping isrelatively weak. Currently, how to regulate the pet keeping in a necessary degree, howto perfect legal regulation system of the pet management, and how to regulatebehavior of keeping the pet while defining the keepers’ rights in order to minimizenegative effects of the pet keeping are the issues which ought to be settled downfirstly in our country.This thesis based on legal regulation, explores the development trajectory, statusand inadequacies of legal regulation in our country, at the same time, and draws onuseful experience of foreign countries, and then puts forward suggestions in line withChina’s national conditions.The first section has an overview of legal regulations on the pet keeping. Itmainly addresses the currently basic understandings of legal regulation on the petkeeping in theoretical circles, the basic requirements by currently existing legalregulation on the pet keeping in China, and the significance of strengthening theorystudy on legal regulations on the pet keeping. The second section showes a discourseon the basic system of legal regulation on the pet keeping. It proposes a legal mode ofregulating the pet keeping in paying equal attention to the keeper’s rights andobligations. The third section gives a brief introduction to the basic situation of legalregulation on the pet keeping in foreign countries. The author chooses some exampleslike the United States, Britain, Italy, Japan, the South Korea so as to conduct moretargeted introduction. The introduction is mainly about history and current situation oflegal regulation on the pet keeping, and the specific institutional framework in thosecountries, and the significance to China. The fourth section focuses on the problemsof legal regulation on the pet keeping in our country, deeply analyses the reasons,and proposes some solutions. The current problems of legal regulation on the petkeeping in our country contain: legal system of the pet keeping lags behind, the scope of regulation application is narrow, governmental regulation is not in place. Theauthor finds out the reasons for these problems by analyzing the facts whichlegislative thinking of the pet keeping is unclear; public participation and attention isinsufficient. To deal with such situation, the author puts forward three majorstrategies:unifying pets keeping legislative ideas; improving social self-discipline ofthe pet keeping, and combining legal regulation, governmental regulation with socialself-regulation.This thesis has the following innovative areas:the author sorts out the course oflegal regulation on the pet keeping:in this process, the author innovatively discussesthe existence of the "ban on keeping" stage, and sums up in recent years new trends as"standard keeping stage"; discusses the legal significance of the concept about the pet,and fully explores in the article on the concept of the pet; especially discusses thenecessity and feasibility of penetrating the plants and other non-pet animals into therange of "pets";explores the rights and obligations of pet keepers: while exploring theobligation, the author explores the necessity of rights, and fully discusses them; putsforward solutions: while extracting related problems, the author carefully analysesthem and put forwards the corresponding countermeasures.
