A Study On Collective Forest Property Right System In Guizhou Minority Areas

The collective forest property rights system reform has made progress in thephasal sense in the minority areas of Guizhou province from2008. Because of thespecial geographical environment and the complex social situation and uniquenational customs in Guizhou minority areas, the collective forest property rightssystem reform neither complete nor standard. Because of many problems left over byhistory, the legal disputes and conflicts that are related to forest property rights alwayshappened. Compared with other parts of the country, the collective forest propertyrights system reform in Guizhou minority areas generally started late and proceededslowly. The collective forest property rights system reform is a key factor to theimprovement of people’s livelihood and has a positive role in promoting themaintenance of ecological balance, the harmonious development of man and nature.Based on the indistinctiveness of right of property, it is an important topic tostrengthen the result of the collective forest property rights system reform in nextstage on how to through coordinated reform. To take full advantage of the abundantforest resources of minority areas, it must carry on the property reformation of forestresources. Property and its stimulative role in the promotion of the circulardevelopment of forest economy, the reality of harmonious development of human andnature through the improvement on forestry real rights system in minority areas. Toguide the reform of collective forest rights smoothly and deeply, it requires anin-depth study on multiple operating modes in minority areas, the legal system that isworth popularizing the achievements of the reform, and formed the legal system ofcollective forest right system gradually in this stage.The paper consists of three chapters, according to logic relationship of the basictheoretical elaboration, the practice research, raising the question and solving theproblem to write. Start from the object and content of collective forest property rights,the first chapter explains the scope of the object of collective forest property rightsand specific powers and defines basic concepts of collective forest rights. Through acombination of relevant laws and regulations and research results as well as the unified national style "Forest Right Certificate", the paper’s research scope derivedfrom the object of the forest right argument. Combined with empirical research, thesecond chapter evaluates and analyses the performance on the reform of collectiveforest right of Fanpai Village and Pinzhao village, taking the reform of collectiveforest rights in Guizhou province’s Taijiang County as the reference, and analyses thecause of difficulties in practicing of the collective forest right system reform inminority areas of Guizhou province from the three aspects of policy, system,culture.To the question mentioned before, the third chapter makes recommendationson perfection of legal system of collective forest rights in ethnic minority areas at first;puts forward the practice suggestion on the construction of protection of the rights andthe exercise of rights, with related laws and regulations and policy documents inGuizhou province; offers the strengthening of the use and coordination of custom lawof minorities finally, with the unique national customs in Guizhou minority areas.
