Research On Causes Of And Countermesures For Solving Property Right Disputes Of Collective Forest In Tonggu County Of Jiangxi Province

Since 2008, collective forest tenure reform has been comprehensively pushed forward, and property right disputes of collective forest have attracted much attention. Domestic research focus on causes and Countermeasures of property right disputes. Few domestic scholars have done little research on it. In this study, set a key county of southern collective forest tenure reform as the study area, the causes of property right disputes of collective forest are analyzed to render regular system of collective forest rights disputes related problems, enrich existing research literature and relevant for the future study provides reference information.Firstly, clarifies the key concepts of property right disputes of collective forest, identifies the definition of key concepts in this paper, and constructs theoretical framework. Secondly, reviews all previous collective forest tenure reform in Tonggu, and lay the foundation for the analysis of property right disputes of collective forest. Third, based on the historical perspective of the causes, comes to conclusion that there are different degrees of property right disputes in different historical periods. Fourth, combined with field research of rural households to obtain data, uses the Logit and Probit model to analyze the impact factor on property right disputes of collective forest. The study shows that age of household head, household labor force, household income, total forest area, commercial forest area, the number of commercial forest land, whether over the past decade been carried out have significant impact. Fifth, through the analysis of typical cases, combs the design of the system of property right disputes resolution, as well as the system dilemma of property right disputes resolution.Based on the above analysis, this paper presents the following development proposals:First, to strengthen border demarcation and registration of collective forests, encourage farmers to carry out the transfer; second, to strengthen the importance of collective forest rights disputes, dispute mediation to enhance capacity-building institutions; third and step up publicity efforts to popularize knowledge of the law; fourth, strengthen the promotion of forestry cooperative organizations, to provide services for farmers; fifth, strengthen the collective forest rights dispute settlement system of top-level design.
