Interest Game And Legislative Trend Of Real Estate Tax Reform

In2003, the ruling party released documents about the property tax reform. In2011,Shanghai and Chongqing started to pilot the housing property tax reform. And this year,the State Council required Ministry of Land and Resources to issue the ImmovableProperty Registration Ordinances. It is obvious that the property tax reform is around thecorner. Accordingly, it has great practical significance that we study on the upcomingproperty tax legislation mechanism and speculate the property tax may scheme. Based onthe above ideas, the thirty thousand words paper is divided into three parts:Chapter I analyses the characteristics and defects of the current property tax system inChina, and demonstrates the necessity of property tax reform. On the basis of schemes ofproperty tax reform, put forward by scholars, I summarized three possible plans withdetailed explanations.Chapter II, it starts with analysis of potential beneficiaries and their demands in theprogress of property tax reform. Then the paper discusses the current situation andlimitations of the legislative game mechanism in China. Combined with the legislationpractice, it speculates the possible legislation process. The game subjects express theirbenefits by means in the legislation process, in order to affect the reform program ofproperty tax.Chapter III, it describes the characteristics and tendency of the pilot schemes inShanghai and Chongqing. According to interest game in the legislation process, discussedin chapter two, the future property tax reform will little affect the real estate prices.Reforming tax system without constitutionalism, the housing property tax system, or eventhe whole tax system, trapped in the strange circle of Zongxi Huang’s law is inevitable. Inthe end of the paper, it proposed a possible method of realizing constitutionalism in China.To start with, reforming individual income tax and adjusting macro tax system, in order todevelop the citizen’s consciousness of tax and citizenship. Furthermore, let the NPC getbudget approval, so as to control the power of government and realize constitutionalism.
