Since the implementation of "anti-monopoly law" in2008, the State Council and the anti-monopoly law enforcement agencies have issued corresponding rules on the law enforcement agencies and their responsibilities. However, the enforcement agencies are not good enough to meet the requirements of the anti-monopoly law. This paper is focused on the research of problems about China’s local anti-monopoly law enforcement agencies hoping to make some contributions to the future improvement of China’s local anti-monopoly law enforcement agencies.The paper firstly tells us that our provincial law enforcement agencies are authorized by the central government agencies through analysis of China’s "anti-monopoly law" article nine and article ten. The law enforcement mode has its historical and realistic reasons. But with the development of market economy, changing of law enforcement environment and the monopoly situation, the local government agencies cannot fundamentally prevent and stop the monopoly behavior. Then, analyze the problems of the local enforcement based on China’s anti-monopoly law enforcement agencies’ situation, which are mainly that they are not professional enough, low administrative level and lack of independence. The last part is about the author’s idea on Chin’s future anti-monopoly law enforcement agencies’setting up. The author selected American, Germany and Japan to be compared. Firstly, relevant elements should be considered. Considering the current law enforcement environment, in the local, it should be the offices of the central agency which is responsible for the anti-monopoly law enforcement. The last approach put forward is strengthening judicial review to improve the anti-monopoly law enforcement, and providing some constructive suggestions to solve the problems of the anti-monopoly law enforcement agencies.
