Since September2010, a Chinese fishing boat was hit by Japan, the Sovereignty dispute of the Diaoyu Islands between China and Japan becomes the focus of the Asia-Pacific region and the world.Because of the east China sea dispute and maritime rights management differences between this two countries, China and Japan relations is deteriorated.China and Japan both as the maritime countries in the world, have attached great importance to marine management and rights, the strength of the Japan Coast Guard management institutions is the stongerest maritime law enforcement forces except the U.S in the world. Now,Japanese Coast guard management institutions has played a key role in law enforcement work.on the other hand,after China’s State Oceanic Administration and the China’s Sea police were mergered in2013, it is not only ended the status of Chinese decentralized sea power management, but also became an overlooked maritime rights power and law enforcement forces.China and Japan in the management of Marine rights and interests of cooperation and conflict in the future will be how to change,and how to resolve the conflict between the two countries to achieve a win-win situation,which is a big challenge for this two countries in the aspects of political and diplomatic strategy.economic power,and military power.The full text including four parts:The first part mainly discusses Japan’s maritime rights management system which started from the differences between this two countries in the aspects of Administrative departments of maritime rights and interests and maritime rights and interests legislation. The second part discusses china and japan has been cooperated in the terms of fisheries, marine environment and marine resources development.The third part summarizes the Sino-Japanese conflict in the management of maritime rights and interests, and emphasis on that the most important obstacles in bilateral relations is the Diaoyu Islands dispute, East China Sea dispute and energy problems and so on.The fourth part summarizes that the conflict of the Sino-Japanese maritime rights and interest will bring the negative impact to this two countries and even the East Asian region.I really hope to come up with a reasonable solutions to deal with the conflict of the Sino-Japanese maritime rights and interests, which I think can be analyzed from common development and international law.
