Study On Bribery Crime

Accepting bribes as a typical crime, is an important part of our criminal law. Inrecent years, as the development of China’s economic and of society, taking bribes alsoshowed many new forms and contents, mainly as diversity complicates the object ofcrime, crime and other criminal means body situation, coupled with our currentcriminal law legislation and judicial interpretation of bribery imperfect, for newproblems involved in judicial practice does not give uniform standards, issues related toaccepting bribes judicial determination difficult. Author selected a typical case frommultiple bribery crime, the legal issues of bribery for judicial practice often involvesnew situation, combined with the analysis of existing theoretical results demonstrate,finally put forward mine legislative proposals on the crime of bribery.In addition to the introduction and conclusion of this article is divided into fourchapters. The first chapter focuses on bribery crime case and controversy, Chapter II,Chapter III correspond to the qualification of criminal cases that appear in the objectiveelements of the crime, crime and other related objects identified problems with theexisting theoretical results in detail discusses the fourth chapter to the case and make afinal conclusion on relevant issues reflected in the case, combined with the reality ofour country and the mainstream international legislation, proposed legislation toimprove the proposal.
