With the development of China’s socialist market economy,many state organs, enterprises and institutions and other units begin to have bribery problem, especially in some companies, enterprises and other units of non-national staff of bribery. Those people using their position to facilitate illegal soliciting or accepting other people’s property and various forms of discount, fees, seek illegitimate interests in economic exchanges, causing large economic losses to many companies and also greatly affected the industry atmosphere. Under this grim situation, the government unveiled the relevant laws to regulate and punish this action. For example, the section163of1997’s Penal Code, the corporate officers taking bribe is also called non-national staff taking bribes. The football referee bribery cases recently aroused great repercussion in the community that belongs to the category of non-national staff taking bribes. Our government also gradually introduced a series of laws to regulate the Black Whistle behavior for the football field. Principles of fair sports competition in China’s Sports Law Section34provides that sports competition organizers and athletes, referees and coaches in sports competitions which shall not fraud, favoritism, must comply with the principle of fair competition, the relevant rules provisions and sportsmanship. Soccer referee’s illegal enforcement violate the provisions of the Sports Act and related laws. And it is a sports corruption problem should beregulated by the criminal law. Football is the largest sport in the world, many countries have the similar problems. Football corruption cases occurred in our country in2012is particularly harsh.In this paper, the writer will introduce the necessity and practical significance to prevent the non-state staff bribery and bond with the Chinese football corruption cases, using comparative analysis, case studies and empricial research methods, elaborate the objective aspect, subject, subjective aspects of this crime. This thesis specifically explains the subject of crime. As for the objective aspects, it makes a thorough analysis and study on a series of issues, like the particularity of taking advantage of certain positions, the identification of claiming or taking bribes illegally, the importance of working for others interests and the criminal target in a principal crime. What’s more, I have put forward some personal views and suggestions in this article as well.
