Research On Flexible Administrative Law Enforcement Of Urban Management

Urbanization is one of the concentrated reflection of human civilization as well as adevelopment trend of human progress. Urban existance and development is on condition ofsound management and service. The current urban management enforcement of law,however, suffers from widespread chaos. As the concept of service-oriented government isdeeply rooted in the hearts of the people, the urban management enforcement practicesthroughtout the world also start to explore flexible administrative enforcement measureswith the characteristics of persuasion, inculcation, guidance, direction, covenant and so on.How to summarize and analyze the flexible administrative enforcement measures in theory,and then further promote the revolution of city management to urban governance inaccordance with requirements of the rule of law, in order to effectively resolve socialcontradictions, innovate social management and expedite impartial and honest lawenforcement? This is not only a focus of attention and academic responsibility foradministrative law scholars, but also a subject that deserves dedication of colleaguesengaged in urban management law enforcement.This article, based on the urban management enforcement practice, probesstandardization and scientization of urban management flexible administrative enforcementmeasures. First of all, this article reveals the current chaos in the urban managementenforcement, and analyzes the reasons for the reality behind, system and legal norms.Second, it intruduces and reviews several viewpoints of urban management reform inacademic circles and governemnt at present. Third, it discusses the rationality of the urbanmanagement flexible administrative enforcement measures from the the perspective ofpromoting social fairness, coping with urban management complexity, reshaping the imagefor urban management, protecting citizens dignity, and maintaining social harmony.
