Research On Legal Issues Of Financial Equipment Leasing Of Medical Equipment

Financing lease, as a way of financing, it has been adopted in China for a long time, however, it is not very long while it has been used in medical equipment. In recent years, medical equipment of our country market filled with fierce competition, medical equipment finance lease is paid more and more attention. Compared to the foreign medical equipment finance lease law theory, the domestic research about medical equipment finance lease law problem is not mature, laws and regulations in our country are relatively loose, and our country medical equipment finance lease take strict regulation pattern limited the rapid development of medical equipment financing leasing. Therefore, it is very urgent to study our country finance lease law system of medical equipment and provide a good legal environment for our country medical equipment financing.Under this background, this paper inspects the development of financing lease, draws lessons from foreign financing lease law theory and method, then analysis medical equipment finance lease involves risk and its prevention, to study legal issues of medical equipment finance lease in our country, and on this basis put forward legislative proposals of normative medical equipment finance lease in our country.The article is divided into five parts. The introduction section reviews the background and development of medical equipment finance lease in our country, then draws out the purpose of writing this paper.The first chapter reviews the basic theory of financing lease, then probes into the basic theory of medical equipment finance lease contract, to illustrate the concept of medical equipment finance lease, gathered the advantage of financing lease way of medical equipment, as well as hospitals now commonly used mode of financing lease in our country, and analysis the content and characteristics of the medical equipment finance lease contract.The second chapter studies the medical equipment finance lease contract risk may exist in the process of implementation including the subject eligibility risk, leasing property rights risk, then puts forward some prevention advice.The third chapter studies the present legislation situation of medical equipment finance lease in our country, points out the existing problems combining with the content of the second chapter and puts forward the perfect proposal from the regulatory system, registration system and the fiscal and taxation system.The conclusion part summarizes the main ideas of the former three chapters,including main points and conclusion of each chapter, and reiterated the research conclusion of the full text.
