Privacy Protection Under Network Conditions

With the speedy development of internet technology, the link between social activities and internet is getting tighter and tighter, bringing both great convenience and numerous problems, of which the tort of internet right of privacy attracts the most attention. The internet privacy is evolved from traditional right of privacy and actually it is the internet form of personal information in the modern society. Due to the characteristics of internet which is digital, open, and technical, it makes the personal information more useful, of more economic value, and at the same time more fragile, so it is very necessary to give particular protection to internet right of privacy.This paper is divided into four parts, the first part mainly discusses the basic content of the right of internet right of privacy, including its history and development, and focuses on internet right of personality, proposing to lead out the protection of internet privacy right field by elaborating the content of the right of privacy, at the same time, discusses the significance and the research value of the internet right of privacy protection and clarifies the necessaries and urgency of internet right of privacy protection, which is one of the important content of personality right protection. The second part discusses the tort of internet privacy, including the general tort behavior and the main form of internet infringement. This section intends to summarize and analyze the forms of internet tort in real life, basing on problem solving after the discovery of them. The third part put forward different ways of internet right of privacy protection, including both foreign and China’s way. Different countries may share the different ways because of different historical tradition, cultural environment, legal system, policy orientation. This section combs the current situation of internet right of privacy protection in China and summarizes all kinds of internet privacy protection from the point of comparative study of the protection of internet privacy in the United States and the European Union. The fourth part is about a plan for China’s internet privacy protection, establishing a comprehensive and scientific internet privacy protection system based on a full analysis of protection measures in other countries and drawing lessons from the legislation management experiences of advanced law domain, and fully unified the status quo of China, from the legislative protection, industry self-discipline protection, internet moral construction, protection of technology, international cooperation.This paper argues that, only by strengthening internet right of privacy protection can we promote the healthy development of information internet. In order to protect internet right of privacy, we should handle both the free flow of information and the right of privacy protection, not unduly restrict the development of internet economy while realizing the protection of internet right of privacy, and should have a reasonable balance mechanism and establish a protection system consistent with the actual situation of our country, in which way only can we promote the protection of internet right of privacy.
