As we are sharing the prosperity brought up by industrial civilization, environmental issues such as pollution, resource depletion also present serious threats to our lives. It has been a universal consensus that the protection of environment and sustainable development should be the solution for a better world. However, the practice of environmental protection in many countries has made it clear that the traditional means of administrative and legal management have shown its lack of power in controlling pollution. Therefore, financial control has been introduced, to guide enterprises to improve their management so that both economic incomes and environmental benefits can be brought to the enterprises and to the society. Under such circumstance,"green loan" is introduced to play its role in economic regulation.Many international organizations, foreign governments and banks have introduced policies to promote environmental protection. However, as a newly introduced policy in China,"green loan" faces many difficulties in its implementation, and the most critical one is the absence of an effective legal system.This paper, aiming at analyzing these problems and providing some reasonable suggestions, mainly consists of four parts. The first part presents a general concept of "green loan"; the second part introduces the implementation of "green loan" in international organizations, foreign countries and foreign banks; the third part is an introduction of the legal practice of "green loan" in China; the forth part is the legal difficulties of "green loan" and the author’s suggestions on this matter.
