Traditional theory on rights arises from the needs of the industrial production development after the Industrial Revolution, which is constantly improving itself, consistent with the development of the times and the historical trend of the bourgeoisie accessing to power and establishing democratic politics. The most giant challenge on the traditional theory on rights is the rapid development of information technology after the new technological revolution.Both at home and abroad, people are more inclined to adopt the perspective of pragmatism to explain some new phenomena and settle some new problems in the face of the aforementioned challenge. Currently, scholars are more willing to concentrate in the fields of branch law when discussing the relationship between information technology and rights, but pay rare attention to jurisprudence. In other words, scholars do not treat it as a separate issue to be viewed in their perspectives.This article firstly offers a comprehensive collection of data in the field of jurisprudence and information technology, and systematically reviews the present status of information technology progress and the approaches of traditional theory on rights. Then, on the one hand, this article demonstrates from view of the right structural elements, how information technology transformed the traditional theory on rights. On the other hand, this article also illustrates the theory of rights have evolved in some way, and shall continue to evolve directed by certain value goals, to respond the impacts and challenges brought by technological progress.This article focuses on ontology of right, noting that under the impact of the advancing information technology, rights have undergone some significant changes in terms of denotation and connotation. The author believes that a constructive interpretation of traditional theory on rights shall be implemented under the guidance of a value target of overall balance, and that rights theory also requires a constant and humanism introspection on itself.
