Constitutionalism Of Humanism

Humanism is philosophic cognition which takes people as the value and measure. As the tool or means to maintain and promote people's pursuit for happiness, freedom and consciousness and overall development, constitution shall take humanism as fundamentals. We must ask how to give a theoretical cognition on the relationship between constitutionalism and humanism ,and how to take humanism to realistic life from constitution. This is the intention of study of this article.The thesis consists of four chapters. Chapter one mainly discusses some basic relative problems. We trace back to the history of humanism of west countries and China for correct cognition on humanism, and analyze the meaning of humanism in modern China. Chapter two discusses the problem of relationship between humanism and constitutionalism. Separately from the theory which produces constitutionalism, the constitution manifests to humanism. In particular we prove the relationship between the human rights and humanism. Chapter three mainly compares the western various countries humanism performance. Achieved constructs humanism to our country constitutional government model significance. Chapter four analyzes in our country constitutional government development the humanism display not to be supposed to have function origin, proposes consummation constitutional government person this spirit suggestion: cultivates the citizen the constitutional government to realize, develops market economy, establish a constitution investigation committee under the National People's congress, consummates the constitution censorship.
