A Study On The Prevention Of Duty Crime In China

The prevention of duty crime which has very important significance for the country and society is closely related to everyone’s life to the sustainable and healthy development of a country’s economy, as well as the external image of a country is positive or not. It’s a significant issue that China should insist exploring referring to how’to correctly guide officers to exercise his power appropriately in order to reduce duty crime from the source. In the first chapter, based on the analysis of data of duty crime in nearly five years, the meaning of our country to carry out the duty crime prevention work and the research situation of prevention of duty crime in domestic and abroad respectively are introduced hoping to conclude experience for our country. Then the basic concept and new features of duty crime are summarized with the basic theory research of prevention of duty crime, so that the late targeted prophylaxis can be proposed. At the same time, the necessity and feasibility of prevention of duty crime are studied in the second chapter. The third chapter introducing advanced duty crime prevention mechanism in Singapore, Sweden, and other countries, the author concludes excellent prevention experience according to China’s political and economic situation. The fifth chapter is about the analysis of the status quo of prevention of duty crime, and the reason of the shortcomings in law. Back to reality, the feasibility of perfecting our country’s duty crime prevention measures are put forward, which is the focus of this article. The mesures mentioned by the author are as followings, perfecting the system of laws and regulations; specification of talent selection and appraisal system; procuratorial organs optimization report channel; building system of official property of the public; strengthening the cooperation of companies, government and inspection. The thesis try to find a new way of duty crime prevention by combining state-owned enterprises, to explore the government and the state-owned enterprise internal duty crime prevention of new ideas.
