On International Legal Control Of Transboundary Movement Of Hazardous Wastes

Since the1970s， the transboundary movements of hazardous wastes began toappear.For the sake of significantly managing the threat of the transboundarymovements of the hazardous wastes， the international community began to focus onthe development of dangerous wastetransfer in the field of international law in recentyears， and signed a series of conventions， protocols and soft law.The Signing of Basel Convention on the Control of Transboundary Movementsof Hazardous Wastes and Their Disposal provided a legal framework for themanagement of transboundary movements of hazardous wastes in the globallegal system， and that is the first international convention of management oftransboundary movements of hazardous wastes in human history. Agreements areestablished on "management of transboundary movements of hazardous wastes andtheir disposal ".This paper tries to study the related literature at home and abroad，and introducesthe legal concept and the international legal system of the transboundary movementsof hazardous wastes. This paper tries to find new characteristics and ideas ofinternational legal control of the transboundary movements of hazardous wastes，andproposes suggeations for the legal system of the transboundary movements ofhazardous wastes of our country. This paper tries to develop and improve the researchand practice of the transboundary movements of hazardous wastes.This paper is divided into six parts. The first part is the introduction，introducing the research background， significance and current research situation athome and abroad. The second part is including the definition of hazardous wastetransboundary and analyzing the causes and damage of the transboundarymovement of hazardous wastes. The third part is introducing the international legalsystem on the control of transboundary movements of hazardous wastes from the twolevels of global and regional conventions. The fourth part is analysing thecharacteristics and problems of international legal control of the transboundary movements of hazardous wastes. The fifth part is introducing new ideas ofinternational legal control of transboundary movements of hazardous wastes. Thesixth part analyzes the present situation and existing problems of domestic legislationof transboundary movement of hazardous wastes in China， and giving proposes onimproving transboundary movements of hazardous wastes.
