On The Protection Of Grassroots Police 's Rights And Interests

The police are the embodiment of social justice and the patron saint of publicinterests. But with the continuous development of the social economy, variouskinds of social contradictions emerge in an endless stream and assaulting casesoccur frequently throughout the country, which leads to high records of the policecasualties. As a result, the law enforcement rights are greatly infringed and thephysical and mental health of the police is worrying. In the face of the harsh socialreality, we should be more scientifically define the connotation of police rights andinterests protection, comb the existing problems seriously, analyze calmly thereasons why the police’ rights and interests are being infringed, and exploreeffective countermeasures actively, to safeguard and maintain the police legitimaterights and interests and to provide a strong support for the construction of China’ssocialist rule of law.The connotation of the protection of the police’ rights and interests can beanalyzed by two theories, one is law enforcement and the other is rights andinterests, which is selected in this paper. Strengthening the protection of thepolice’s rights is conducive to better fulfill the police’s duties, to reduce theoccurrence of assaulting cases and to create a harmonious environment. At presentthe phenomenon of infringement cases mainly presents the following features:huge workload makes the worrying mental health; policeforce is seriously understaffed and many police are broken down from constantoverwork; assaulting cases occur frequently and police’s life safety is threatenedgreatly; malicious complaints increase and police’s reputation is infringedseriously.This paper concludes the reasons for the infringement of police’s rights: hugeworkload makes the worrying mental health; police force is seriously understaffed;internal operational efficiency is low; police’s overall quality is not high. Reasonsfor the infringement of police’s life safety: laws and regulations are imperfect sothe penalties are still inadequate; the poor law enforcing environment affects therelationship between the police and the people not so harmony;professional training lags behind; weapons and equipment need to be improvedurgently. Reasons for the infringement of police’s reputation:the inadequate laws and regulations; relative radical public opinions.Here are several countermeasures to protect the rights and interests of thepolice: for the rights to mental health, investigate the mental health status andpsychological quality, offer psychological counseling services, and carry outmental health education and psychological training; for the right of rest, increasethe degree of the attention of the leadership at all levels, increase work efficiencyand change the way of thinking; for the most important right of lifesafety, improve laws and regulations, increase the input of funds, construct earlywarning system, optimize the law enforcement environment andimprove policemen’s quality; for the right of reputation, several countermeasures have been summarized: establishes the perfect surveillance laws and regulations,instituted a reputation protection agency, optimize the law enforcementenvironment, strengthen the communication with the media and continuouslyimprove their quality.Currently, our country is in the midst of emergent period of contradictionsamong the people, in the high-incidence season of criminal offenses, so publicsecurity bureau takes on much more onerous work than ever before. Respect thepolice is to respect state authority and protect the police is to protect ourselves.Only protecting the legitimate rights of the police’in the first place can peopleslegal interest is protected so as to build good environment for the construction ofharmonious society.
