On The Information Disclosure Of Public Enterprises And Institutions

With the enforcement of regulation of the People’s Republic of China on the Disclosure of Government Information(hereinafter referred to as regulation),the disclosure of government information is developing and improving. With the phenomenon of streamline administration and institute decentralization, the subject of the disclosure of government information extend from administrative organization to public enterprise and public institution. Therefore,people pay more attention to article 37 which is about the disclosure of government information. Because article 37 is not detailed enough and lacks effective administrative interpretation, there comes a lot of disputes in some cases with public enterprise and public institution as the defendant, such as public transport companies, water supply companies and electric power companies. For example, the subject of the disclosure of government information of public enterprise and public institution is not clear; the limit of disclosure and confidentiality is not clear; procedure guarantee and relief system are not consummate. There are not clear legal rules and authoritative administrative interpretations for these disputes, therefore, the disclosure of government information of public enterprise and public institution is needed to be consummated, in that case, it is good for them to establish standard operating procedures and good for people to guarantee their rights.The article is divided into five parts. The first part is the introduction which introduces the purpose of research, research significance, research status and the frame structure of the article. The second part introduces the theoretical basis of the disclosure of public enterprise and public institution information, including the core concept, characteristic, necessity, particularity and the relevance to the privatization of the public institution. The third part based on the article 37 of regulation analyze the legal system and the present situation of disclosure of information, sum up the disputes. The fourth part introduces the existing problems of the disclosure of public enterprise and public institution information. The fifth part propounds suggestions and countermeasures of the disclosure of public enterprise and public institution information.
