The property right of human capital is made up of five functions --Ownership , possession , using right,disposition right and benefit right. It can be deemed to be in the " complete state " in case five functions whose price decided by market and trade is free are all in existenc, clear in the border, steady in their rule, guarantee to carry out.,otherwise it can be deemed to be in the " incomplete state ". As a kind of special advanced human capital, an operator is one of the pivotal factors of enterprise's success or failure. It is important that the state of operator's human capital in state-owned enterprise is inspected from the angle of benefit right. In theory,at first,operator's benefit that must be in accordance with high cost investment is decided by formative fashion and avenue of human capital. Secondly, there have some reasons of attaching importance to operator's benefit right which are characteristic of property right of human capital about operator,gathering head operator's ability of bearing risk,creating huge wealth and operator's strong negotiatic force.Thirdly,to assume limited sense,to combine character of modern enterprise, entrusting-surrogate theory analyses the influence of irrational benefit to operator. Finally, the western share economic instructs that worker participates the surplus benefit of enterprise . It has pay more attention to the fact that how to preserve and appreciate the value of state assets as material capital with the state-owned enterprise introduced to the market,the operator's benefit right of human capital which is idiosyncratic human capital as the productivity 's modality whose marginal return increase by degrees hasn't implement well,they decide the income of operator in state-owned enterprise on the criterion of worder's endurance,operator's income is lower, configuration of benefit is single, welfare'configuration is irrational,and they hardly have ask for surplus benefit.This kind of salary distribution lose efficiency as well as justice, but also there is no strict restraint in on-the-job consumption.
