Certification Of Developing Country's Subsidy And Its Countervailing Measures

Canada and America have extended the scope of their Anti-subsidy Law to theNon-Market Economy Country, including China. Thus the condition of China'ssubsidies and countervailing is very serious. It is urgent for Chinese government andenterprises to take some actions to avoid the Anti-subsidy Activities of other countries.The thesis begins with the basic clauses of Agreement on Subsidies andCountervailing Measures and expounds the favored treatment to the developingcountry, combining the practices of China, the author give some feasible suggestionson how to avoid the Anti-subsidy Activities.The thesis consists of five parts: The first part is the preface, which summarizesChina's subsidy conditions and the internal and external subsidy environment;Thesecond part is about the affirming of subsidy activities and its scope, which includethe principle of WTO and the other counties;The third part expounds the specialtreatment to the development country and the economic transition countries;The forthpart summarizes the contradiction of our subsidy measure with Agreement onSubsidies and Countervailing Measures;The last part is the most important content ofthe article, which give some feasible suggestions to make the subsidy related policiesand measures legality, including: make full use of unactionable subsidy;transform thesubsidy policies to the state-owned company, make the specificity subsidynon-specificity;choose the fitful interest rate to the export credit, form the industryassociation and explore its potential to help the development of our economy;studythe double status of Agreement on Subsidies and Countervailing Measures, enhancethe legislation and use the trade relievable measure to resist the Anti-subsidyActivities;enrich the legislation of domestic enterprises and industries.The aim of this thesis is to offer some solutions to solve other countries'Anti-subsidy Activities to China, by study the related favored policies to thedeveloping country. It will analysis the internal and external environment of Chinaand give some micro and macro suggestions to avoid the Anti-subsidy Activities toour country.
