The Research On China's Measures Against The Industry Injury Of Foreign Anti-subsidy

A subsidy shall be deemed to exist if there is a financial contribution given by a government or any public body within the territory of a member and a benefit is thereby conferred. Along with the international trade, the problem of subsidy and countervailing has not drawn the common conclusion. Especially since the First World War, more and more countries use the subsidy measures to influence their international trade affairs.After China's accession to WTO, our economy will take part in the international competition on further degree. In the past, we received less investigations and lawsuits of subsidy from other countries. It was not because that subsidy didn't exist in China, but that the developed countries took China as"non-market economy country". They thought that the countervailing law wasn't applicable to non-market economy country, so they often used anti-dumping lawsuit as a substitute. But now, with the establishment of market economy, China's status of market economy will be admitted step by step. Moreover, according to the regulations of WTO, whether the subsidy giver is a market economy country is not taken into consideration when confirming the existence of the subsidy. So, after China's accession to WTO, our country may face the disputes of subsidy at any time.This Article is divided into five Chapters.Chapter 1:Preface. It mainly introduces the article's background, importance and purpose, and then concludes the existent theory on industry injury, industry injury early-warning system and so on. Finally at the base of this expatiation, a generalization is done with a frame format which clearly reflects the frame, the keystone and the logic configuration.Chapter 2: Economic analysis on subsidy, countervailing and industry injury. In the beginning, this article makes an economic analysis of subsidy and countervailing duties to find out the rationality for regulating subsidies and countervailing measures. And then, it gives a interpret on economic effect of subsidy and countervailing in details. This part is mainly around the basic theories, which is the article's theory basis.Chapter 3: The confirming means about the degree of industry injury coursed by countervailing. First, this part uses the traditional qualitative analysis method to interpret the degree of industry injury coursed by countervailing, while almost scholars use this kind of method to study it, there little literature use quantitative analysis, so using quantitative analysis to study the degree of industry injury coursed by countervailing is the most important and difficult part.Chapter 4: The countermeasure on answering the countervailing to maintain the industry secure in currently position. At last in this part, I apply fuzzy synthetically judgment in this case to affirm the injure degree cased by countervailing in quantitative.In the current economic globalization, domestic industry will be more and more impacted by foreign strong industry with increasing open degree to the outside world. The development of domestic industry can be frustrated, to such an extent that be closed. It is more common in developing countries when compared with strong developed countries. It is imperative for us to strengthen anti-dumping researches. In fact, industry injury early-warning is exactly an important epitome of enforcing anti-dumping.
