The Study On Farmland Expropration And Peasant's Right Ensure Of The Heilongjiang Province

With the accelerated development of China's urbanization and industrialization, social contradiction, especially the decline in the peasant's living standard and also unemployment caused by farmland requisition became more and more prominent in many regions. Such problems also obviously exist in the procedure of farmland requisition in Heilongjiang Province. It severely damaged the interests of land-losing peasants. This problem has become one of the most important factors that influence the social security in the long term and become an obstacle of building harmonious society. Therefore, it is extremely urgent to regularize the behaviour of government farmland requisition as well as to protect land-losing peasants'legal rights and interests.Reasonable compensation for farmland requisition is the core issue to achieve land-losing peasants'rights and interests. This paper is to introduce the consolidated land price in setted region used as a compensation method in Heilongjiang for farmland requisition. It systematically analyzed the manifestation and the forming reason of problems existing in Heilongjiang farmland requisition procedure. The main problems are:discretionary expansion in farmland requisition scale, non-programmed decision in the procedure and low compensation standard. This paper also studied the lost territory peasants'benefit guarantee mechanism in Heilongjiang Province. Furthermore, it shows suggestions for farmland requistion in Heilongjiang Province through introducing successful experience used in Shanghai and Jiangsu as protection peasants'benefit in farmland requisition process, such as-soundly legal protection mechanism, rigorous procedure, emphasized peasants'benefit protection and good employment mode. Finally, in connection with peasants'rights protection during farmland requistion in Heilongjiang, the writer gives advice to further improve and reform local farmland & property mechanism:such as to build public benefits protection systems for farmland requistion, improve procedural protection mechanism for land-losing peasants'rights and benefits, set up new compensation systems, improve peasants'community safeguards and minimum living guarantee mechanism, build endowment security and hospitalization security systems, improve employment security system, strengthen management of social security fund and deeply reform household registration system.
