Research On The Protection Of Rights And Interests In The Transfer Of Farmer's Farmland In Huixian City

Nowadays due to the constant development of the Rural economy in our country and acceleration of land circulation process,farmers own rights and interests related problems also follow.Rural land for farmers is the basis of the source of all living security,so the rights and interests of rural land circulation caused bu the infringement Problem are equivalent to influence their family stable source of farmer is income.laws and regulations setted by the government explicitly stipulated and strictly protect the relevant land rights and interests of farmers,so as to safeguard the rights and interests are not harmed by outside factors.Nowadays the problem of rural land circulation is rights and interests has become an important influencing factor of the land circulation.Whether,the guarantee problem of rights and interests could be solved directly affects the enthusiasm of farmers for the land circulation.This article,which including the visit and investigation for 350 samples from part of villages in Huixian,analses the related problems of rural land circulation from the multiple perspectives,and gets following conclusions.Firstly,in part of the town in Huixian Xinxiang City, farmers can not enjoy the fu ll right of land contractual management, the adequate right to dispose and the reasona ble usufruct in the process of agricultural land circulation.Secondly, some farmers hav e little cognitive of their right in land circulation, so it causes conflict. The correspond ing policy for the price of the land circulation is imperfect, and the land contractual m anagement rights can not be paid in a timely manner to ensure the right of farmers, an d the corresponding mechanisms are also not perfect in land circulation. These factor s all affect the guarantee of rights of individual farmers involved in land circulation i n Huixian City. Thirdly, through corresponding improvement of the land circulation s ystem, and the reform and innovation of the form for farmers agricultural land circulat ion, and the acceleration of the construction of agricultural land circulation market, an d the normalization of government behavior in circulation, we can fundamentally guar antee the individual rights of farmers involved in land circulation.
