On The Improvements Of The Administrative Regulatory Mechanism For The Tendering And Bidding Of Government-invested Construction Project

The tendering and biding of government-funded construction project is a hot-issue in our society. Since the enactment of the Tendering and Bidding Law of People's Republic of China, the tendering and bidding markets of government-invested construction project has enjoyed a continuous development: the bidding area keeps expanding, tendering and bidding activities come under increasingly competent regulations, and the social and economic benefits become more and more significant. The tendering and bidding mechanism plays a positive role in creating a fair market, improving the efficiency and quality of public procurement, safeguarding the interests of the state and society, and pre-empting the corruption in the construction project. However, problems has incurred in our country's tendering and bidding markets during the process of recent mass infrastructure construction and the booming of construction market. These problems hindered the realization of the goals of"open, fair, just and efficiency", and make the tendering and bidding market of construction project a corruption-prone area. Hence, strengthening the enforcement of law in the tendering and bidding activities, and bringing the tendering and bidding of government-invested construction project under better regulation becomes an urgent subject.For the above mentioned reasons, the author selected the research subject as the administrative regulatory mechanism for the tendering and bidding of government-invested construction project. The dissertation will be divided into three parts. In the first part, the dissertation explains the basic concepts, characteristics, functions and the major contents, procedures in the tendering and bidding of government-invested construction project, as well as the legal system, the subject of law enforcement, and mode of law enforcement that embedded in it. In this part, the author with the help of relevant cases, run a though analysis into the problems in our country's law enforcement in the tendering and bidding of government-invested construction project, and discover the crux hampering the effective law enforcement in that area.In the final part, the dissertation provides suggestions for the improvements in the administrative regulatory mechanism for the tendering and biding of government-invested construction project, by learning lessons from overseas experiences and the valuable explorations made by Zhejiang and other regions governments in promoting the establishment of unified platform for the tendering and bidding of government-invested construction project.
