A Designation On The Compensation Of Collective Land Acquisition

Land is the foundation of human's life. It is a natural resource which is the most closely related to human. Since ancient times, land was the central cause of each social unrest and dynastic changes. In recent years,China has entered the stage of quickened industrialization and urbanization,giving rise to a new rural land movement-rural collective land acquisition. In addition, local governments in the "land finance" the great temptation to further intensify the collection of rural collective land. Because there are legal regulations of land acquisition is not perfect, low standard of compensation, compensation scope is narrow, the absence of social security system, landless peasants and other reasons, the rural collective land acquisition compensation and resettlement standards has been a relatively low level. Received in their own interests against the demands of hard to be through the proper channels when a petition to landless peasants, the attitude of confrontation and conflict to protect their own interests. Impact of land disputes have become a country of rural society and stable development of the overall situation of the principal contradiction. This article is based on this background, attempts to explore the establishment of a viable rural collective land acquisition compensation and resettlement mechanism.This paper consists of five parts, the first part is an introduction and analysis of the domestic and international research projects for the current situation, described significance of this study, research objectives, research methods and innovative ideas; In the second, we summ up all the systems of land acquisition compensation and resettlementsince the founding of new China, compensation and resettlement and then make a comparative analysis of the various advantages and disadvantages of these systems, and in-depth analysis of China's current rural collective land acquisition compensation and resettlement problems in the system; third part of the game theory based on analysis of government, open business the rural collective economic organizations, farmers relationship between the interests of the game. Pointed out that the interests of the game in the whole process, the status of the inequality so that they are not their equal opportunity to benefit. The absence of a fair rules of the game, coupled with the participation of the main asymmetric information, the interests of landless peasants can not be maintained through the proper channels of appeal, resulting in a large number of violent anti-sign, petitions. The fourth part of the chapter is a designation on the rural land acquisition compensation and resettlement mechanism, we will raises some policy recommendations, including rural collective land acquisition compensation and resettlement of the basic principles of legal mechanisms to improve the land acquisition to establish the market value of agricultural land assessment imposed, to establish a fair and reasonable compensation mechanism, improve the rights of landless peasants protection mechanism. Part V arizes the conclusions of this paper and the shortages,we summarize the main conclusions and the major limitations of this study.
