Study On Protection Of Commercial Housing Consumers Interests

After we strode the new century, China's urban housing system reform has been thoroughly carried out mainly by residential real estate market booming. It is each passing day which is to promote economic development and to improve living standards that plays an important role. As famous Chinese saying goes:live and work, "home" is related to social stability. However, the interests of consumers in the housing market infringement occurred from time to time affects social harmony. Focus reflected in the commercial infringement are of poor quality, the price is too high, unfair contracts, pledges does not cash, property management is not standardized, consumer complaints and so hard rights. Especially the pre-sale stage is forward delivery housing sales. Its pre-sale through the real estate under construction, from home buyers who obtain financing development funds, leveraging its own funds to less a huge amount of money in real estate development market, which plays "skillfully deflected the question" role. However, in the real estate sale transaction phase. as the status both pre-trade and real estate and personal property of various real-time transactions, real estate sale transactions have a long cycle, poor predictability, high value, subject matter, multilateral pre-contractual relationship, and central and local government policies and other characteristics of control efforts.The pre-stage of analysis and protection of consumer rights is the focus of this study.This article is divided into four parts:Introduction and first chapter is an overview of real estate; second chapter is a comprehensive real estate analysis of consumer rights; the third section is a pre-sale phase of a few key issues:the nature of pre-sale contract, mortgage pre-sale, pre-registration issues, pre-made interpretation of the risk:fourth part of the summary, further emphasizes the significance of housing and consumer protection role in promoting social harmony.
