Research On Consumers' Safety Right Protection Under Perspective Of International Law

Consumers'safety right is the primary right, and also the most basic right. In recent years, with the various consumption security incidents occurring frequently and consumers'consciousness of right protection raising, consumers'safety right protection triggered the international and domestic strong concern. However, the special studies of consumers'safety right protection are less in law circle. Even if there is some study, these studies are mostly cross-sectional under the perspective of national law, including food, medicine, cosmetics and other areas. Therefore, this topic has an important theoretical and practical significance.This dissertation synthesized to make use of methods of normative analysis, empirical analysis and comparative research.This dissertation makes consumers'safety right protection as the objective, studies on the protection of consumers'safety right in the world, region and the states under the perspective of international law, and emphasizes on the protection of international organization to consumers'safety right, the regulation of international covenant and internal agreement, the effort of regional economic entity, and analyses the protection of various country. Through the systematic analysis, the author not only can certainly summarize achievements of our country on consumers'safety rights protection, but also learning from experience and success stories of foreign countries, the author provides the advice on the protection of consumers'safety right.The main body of the dissertation is divided into 5 sections.Section 1 is the basic theory of consumers'safety right. This section discusses the basic theories including consumer problems, the movement of consumer protection, consumers'safety right and indicates the feature of consumers'safety right protection under the perspective of international law.Section 2 is the protection of consumers'safety right in the world. This section mainly studies on the content of UN, IOCU, WTO, CAC about consumers'safety right, reveals the important effect of current international organizations to safety right protection, and put forwards the international organizations'advantage.Section 3 is the protection of consumers'safety right in the regions. This section mainly studies on the safety right protection of EU and Asia, indicates the general situation, legal system, new developments of EU protection and the effort of CAC to protect consumers' safety right.Section 4 is the protection of consumers'safety right in the states. This section mainly studies on the safety right protection of America, Japan, German, France and England from the institutions configuration and legislative development, points out the protection differences of five countries, and shows the respective protection process.Section 5 is the protection of consumers'safety right in China. This section analyses the present social reality of consumers'safety right protection in our country, and concludes the multilateral and bilateral cooperation, domestic breakthrough and protection modes. Furthermore, this section put forwards the guidelines of consumers'safety right protection and improvement measures of international and domestic stage in our country.
