Study Of The Land Acquisition Institution Based On The Justice Standards

Accompanied by the continuous development of the socialist market economy and gradual speeding up of the urbanization in China, the fact that rural collective land is requisitioned for urban construction becomes increasingly more common, during which, the effect of land acquisition will directly affect our modernization and urbanization.At present, China's land acquisition system is not perfect, neither the mechanism of compensation for landless peasants. Therefore, it is urgent and necessary to improve the land requisition system. In this paper, the land expropriation system is taken as the subject to analyze the guiding meaning of land acquisition system imposed by the fairness and justice criteria. Fairness and justice norms seize general attentions from scholars as the core values of contemporary government. This paper has a research from the following aspects.First, based on the analysis on the basic theory of land acquisition, some concepts relating to land acquisition and the position in land management are pointed out, which lays theoretical foundation for the later analysis.Secondly, dating back to the source of justice, the origins of fairness and justice and necessities of following guidelines for fairness and justice in the process of land acquisition of our government are analyzed, starting from the institutional ethics, so as to pave the way for the cause analysis of next chapter.Third, a series of drawbacks in current process of land acquisition in China are analyzed. From the ethical dimension, the main causes of defects and performance are analyzed so as to pave the way for the proposal of following policy recommendations. Finally, the criteria for fairness and justice are proposed as a guide to improve our system of land acquisition strategies and recommendations, i.e. transformation of government role. It can protect farmer's legitimate rights and interests, improve the land acquisition compensation mechanism, and raise the leading status of farmers so that equalize farmers the same rights to possess fair and equitable land resources.
