The Athical Value Study In Land Requisition

Since 1990s,conflicts proceeded from land requisition increased day by day. More and more agricultural lands were forced to change to construction ones therefore interests of farmers were aggrieved greatly. At present kinds of economic development zone were reproved their land range, and rectified lots of land requisition .To keep social equity and promote public welfare are coming to be the main value choice of the public policies. For the land requisition institution meeting the reasonable land demand of the urban construction, promoting the industry structure's improvement, and solving the beneficial distribution's unfairness, ensuring that the farmers could share in economical benefit, is the reformational direction.This paper raised problems of current land requisition to be solved from five aspects of land allocation efficiency, equity warrant of farmers, public administration confidence, agriculture lands protection and safe rice supply of the country, and the concealed land market. By summarizing the theories about land requisition and their ethics value direction, the paper gave its frame of new ethics value direction in order to guide the perfect of the current land requisition institution, and try to solve the double difficulties between economical development and equity protection, In the text, based on the analyzing and comparing the ethics value ideals of different countries and terms, the paper raised the relation of justice, fairness and efficiency. Through the study of public interests and bounds of land power of country collectivity, the paper also gave the suitable ethics value direction and its way to get. Finally by commenting on present social insurance reform relate to farmers that lost lands, and transferring the right to use the construction lands in country, pointed out the innovations and the deficiency.The system of the ethics value direction the writer wanted to set on includes: Maximum of public interests, justice allocation through process justice, compensation justice, strong concern about the disadvantaged groups, stable enhance the living standard of the farmers concerned by the way of lifting the compensation standard and different placement channels, assumption of obligations to circumstance, choose right living style and consumption model.
