| The sixth item of the Regulations on Sealing up, Detaining and Freezing Private Property issued by the Supreme Court regulates that the Court has the rights to seal the housing of the convicts or their relatives, but they are not allowed to auction, sell or mortgage of these housing.This rule was implemented in January 1st 2005, according to which, if the person who loaned from the bank only have one apartment, even if the loan couldn't be taken back, bank and the court shouldn't take this apartment as a mortgage.Housing right is a basic right of the civilian, and the policy made by the Supreme Court protects the right of the civilian, while at the same time increase the risk of personal mortgage. With the implementation of this policy, some banks have stopped the housing mortgage both in public and secretly, and some other banks manifested in public that the personal mortgage is not available for people who buy their first apartment.
