| Recently, disputes in engineering project contract in architectural company are standing out, and they have become the emphasis and problems in contract management. The chose of dispute-solving mechanism is the basis and premise for solving the disputes.In practice of architectural company working, contract disputes are always decided by engineering. But with the development of project practice, the relationship between contractors in project is changing, and engineers'station as arbiter is being challenged by contractors and engineers. More and more scholars are seeking for more reasonable ways for solving the disputes about engineering project contracts, and they all hope to achieve the best benefit for each interest person.This paper researches on the organization building by relationship of stipulation of engineering contracts and discusses the right for each one and the change of the right in organization. Be contrast with other company, the architectural has its own characters. The disputes in architectural are not only related with architectural company, but also related with other company. In this paper, the disputes-solving mechanism will be introduced first, and then following the relationship analysis of all contractors, using the stipulation theory and principal-agent theory explain the change of disputes-solving mechanism in international engineering project, and hope to use the new dispute-solving mechanism (DRB/DAB) for domestic project disputes. This new dispute-solving mechanism can reform the present construction supervisory system, improve the relationship between the contractors, and make the engineering project carrying through successfully.The case of Xiaolangdi Construction Project of the Huanghe River was sited in the paper, and through the case, the paper discusses the advantage and practice of the new disputes-solving mechanism and hope to draw some conclusions to help develop in contract management of construction projects. |
