| Computers have a history for more than 60 years since the first one come to the public. As the human world has stepped into the information society nowadays, computers have become a necessity in our daily work and study. As the development of the modern world, software, which used to be an assistant tool for hardware, has become an independent technology and is developing and improving continually. The development of software technology will become an important factor which will influence the development of computers. Nowadays, software has become the largest industry and is regarded as the essentials industry by many countries. China is a main consumer of software products as well as one of the countries where piracy is rather severe. Piracy has become a tough obstacle for the regular development of software industry and has had a bad effect on it. With such economic background, this essay is an attempt to analyze the relevant problems occurring in the process of the software industry development especially the problem of the protection of the intellectual property right, and with the help of economics , law, and social science knowledge, we are willing to find the origin root of the existence of the problems so that we can figure out reasonable explanations and some possible solutions to improve the software industry development of our country.This essay contains four parts:Part I: The current condition of the internal piracy. We worked out the percentage of the piracy in our market by studying the authentic statistics and chart and comparing the amount and scale of the piracy in foreign market. Second, we point out the real harm caused by piracy by analyzing the different types and characteristics of it. Thus, we fully reflect the real condition of the internal piracy . Part II: The reasons of the existence of the piracy. We emphasize on explaining the difference in the economic property between the software products and material products. It is the key strategy of the sells plan for enterprises because of the specialty of software products. Also, it is one of the reasons for the criminals to produce piracy products. Thus we can find the rooted reasons of it by use the tool of economiocs law and societies science.Part III: The analyses of the intelectual property rights. Using economic theory to analyze the influential factors to judge the rights, we are trying to make the judgment of intellectual property rights more efficient so that we can gain a balance between individual profits and social benefits. We aim to improve the use and development of software resources by protecting individual legal right so that the resource can be fully used.Part IV: Effective approaches to protect software industry and hit the piracy. On the basis of the first 3 pats, we mainly illustrate developing process of the protective system of intellectual property right and its influence on the software industry. Moreover, we propose our own suggestions toward the development of the software industry of China according to the current situation. |
