Property management traced its ancestry back to Birmingham city in British in 1860s, but the actually modern formation of the property management developed in the US in 1920s. At present, the foreign countries have established the perfect legislative pattern about tier-building and uptown property management which focuses on property separate ownership of a building. Chinese property management gave birth to the early of 1980s, and we have made a great contribution on the property management after 20-year development. However, the property management in our country has still been in the primary period with the immature system about it, and the unified administrative code-"property management statute" has enacted as far as to 2003. With the implement of this code, it ended the missing situation of early-stage property management, reinforcing the management of early-stage property units, attributing the property management to the legal track, which finally standardized the early-stage property management market effectively.Property management usually divides into two periods: early-stage property management and general property management. Hereinto, early-stage property management not only is the primary and basic period, but also is the very important step in the implement of property management.Currently, there are many problems in the legal system of the early-stage property management, but the most obvious problem is that our legislation is hard to protect the weak. As for these problems, the property management statute could not solve them completely, besides this, the right of property owner still could not be protected and the limitation in the property management system has not been settled likewise. Therefore, our present legal system about early-stage property management still need farther improved.In this article, author tries to perfect the system of our early-stage property management from the legal and apply aspect of researching the basic theories of the early-stage property management, analyzing the noticeable problems of current legal system of the early-stage property management and the insufficiency of property management statute. Thereby, try to resole the problem of our early-stage property management.
