A Study On Local Government's Ability To Execute The Expropriation Of Land Policy

This article starts off with the definition of ability, combining thediscussion on the natural characteristic of the government's function roleand public policy, and then points out from the result that the executiveability to public policy is the validity in realizing the inherent value of policyand the concrete target. Therefore, evaluating the executive ability to publicpolicy can be considered as one kind of value evaluation, and the resultpattern will be a more proper pattern in evaluating the executive ability. Onthis basis, the writer deems that the indirect evaluation as the way toevaluate the inherent characteristic and the realizing degree of value, onsome significance, is a more thorough method which is more incarnating theultimacy. Hence, the writer chooses it as the method to evaluate the abilityto execute the expropriation of land policy. Correspondingly, the writerchooses the four main value characteristics embodied in the publicpolicy——public, legitimacy, justice and efficiency, combining with theaccording with common benefit requirement, the executing with the lawand the ensuring the land rights of the expropriation objects as the evaluating standard, which is the three concrete targets of landexpropriation policy. At the same time, the writer chooses thecorresponding character evaluation index as the representational index,building the evaluation index system.In this article, the writer tightly links the executing practice of theexpropriation of land policy, and studies the theory and demonstration onthe local government's ability to execute the expropriation of land policy,reaching the conclusion that the local government's ability to execute theexpropriation of land policy goes dissimilation.By thorough analysis, the writer deems that there are three reasonscause the dissimilation of executing ability. They are local governments andtheir official pursuing self-benefits during executing the expropriation ofland policy, the inherent defects of the expropriation of land system and thelack of land supervision over law enforcement, less penalizing and lessdisloyalty on responsibility. Owing to this, this article gives a deeply thoughton improving local government's ability to execute the expropriation ofland policy form three aspect——improving the relevant law system,increasing the breaking law cost and reducing its avails, building correctadministration ethics and scientific achievements.
