Protection Of Trademarks In International Competition

It is not a new phenomenon that Chinese trademarks are preemptively registered by oversea enterprises. But with domestic enterprises taking big strides toward oversea markets, registration of Chinese trademarks, especially well-known trademarks by overseas enterprises had reached its peak.This dissertation focuses on the following parts to illustrate preemptive trademark registration overseas. The first part is the introduction of trademark and trademark right. It lays a theoretical foundation for the following parts. Well-known trademark is specifically emphasized because most of the trademarks preemptively registered are well-known trademarks. Then it briefly introduces preemptive trademark registration. As more and more Chinese trademarks have been preemptively registered overseas, the third part summarizes four trends in this phenomenon. After that, it explores reasons why more and more Chinese trademarks have been registered overseas.Finally it presents suggestions to deal with preemptive trademark registration, which will help Chinese enterprises protect their trademarks in the international market. For those enterprises whose trademarks have been preemptively registered, they can redeem their trademark rights through legal approach or negotiation. For those enterprises whose trademarks are not preemptively registered, prevention is better than cure. Therefore, what they should do is to obey the principle that trademark should go abroad earlier than products.
