Construction contract guarantee /bond is an important credit instrument to guarantee the performance of a construction contract. Since the absence of owners in government investment projects, the lack of inherent mechanism and power for preventing risks is worse than private investment projects. The application of contract bond in government investment projects can not only transfer risks to protect the public investment, but also can effectively reduce the corruption. Through legislation to applying mandatory contract bond in government investment projects is becoming an international trend. Since the government investment projects contract bonding system in our country is in the initial stage of implementation, there are many problems and defects. Through a comprehensive comparative study on the domestic and foreign government investment projects contract bonding system, this paper provides some useful references for us to improve the government investment projects contract bonding system in our country.Firstly, by the theoretic investigation, conception and relationship of surety bond are expatiated in law field, the mechanics of employer payment bonding system is analyzed from the view of information economics. And then, via comparative study measures, the legislative system, bond types, sureties, penalty and bonding varieties of the domestic and foreign government investment projects contract bonding system are analyzed comprehensively and in-depth. In the base of comparative analysis, some advice to solve the existing problems for improving the government investment projects contract bonding system in our country is provided by using foreign successful experience as a reference and considering specific conditions in China.
