On The Protection Of Intellectual Property Rights Of Enterprises Under The Background Of TRIPS

In the economy of knowledge, the development of economic globalization today, intellectual property has become an important asset of enterprises, an important intangible property and the resources to promote the development of enterprises. As the core of international competition is shifted to economic and technological fields, the protection of intellectual property rights is particularly important. The International Intellectual Property, has experienced a series of international conventions, agreements, of which the most important status and role of the most extensive is the "trade-related intellectual property rights agreement."The beginning of protection of Chinese intellectual property rights is later, but actually obtained the achievement in the more than twenty years which attracted worldwide attention, basically forms the intellectual property rights protection system. China has revised the relevant intellectual property right laws and regulations , improved the intellectual property protection level before the accession to the World Trade Organization (WTO). But after joining the World Trade Organization, our enterprises intellectual property rights protection entered in the global intellectual property rights protection system big environment, intellectual property rights question day by day came out. The developed country enterprises take intellectual property rights strategy as an important one for their development . After simultaneously joining the World Trade Organization, the developed country corporations aims at in abundance the intellectual property rights spear point China, repeatedly launches an attack to Chinese intellectual property rights protection domain. The reasons cover both external and internal reasons. Chinese enterprises should learn experience in protecting intellectual property rights from foreign enterprises . It is advisable that Chinese enterprises enhance the awareness of the protection, development and competition of intellectual property rights ,increase investment ,and products of independent intellectual property rights actively and creatively to establish their own brands by relying on their own efforts .Only in this way can they take up a tiny place in the globalization process and survive and development in competition.The paper includes four chapters. Chapter 1 summarizes TRIPS agreement and intellectual property rights protection .In chapter 2,the author introduces some foreign experiences (e.g : America and Japan) in the protection of intellectual property rights which can teach us how to do well .Chapter 3 is about cases and problems in the protection of intellectual property rights of Chinese enterprises .Compared with TRIPS and foreign experiences the author thinks some countermeasures in Chapter 4 which help to resolve the problem above.
