After joining in WTO and TRIPS,it means that the developing countries in general must enhance the intellectual property protection level.Through reorganizating the paper about intellectual property protection,it is discovered that higher is the intellectual property protection level, higher are multinational corporation's geographical superiority, the property rights superiority and the internalization superiority. But the intellectual property protection level is too high which caused FDI reduction. So how the intellectual property protection affects FDI is indefinite.The real intellectual property protection is measured by the Ginarte and Park index,and by the method which utilizes through the former scholar from 1998 to 2009.Selecting three variable of the technical related FDI and five independent variable to carry on the multi-dimensional linear regression. It is said that the intellectual property protection condition not only affects the capacity of FDI, but affects the quality of FDI, so affects the degree of the technical transferring.The paper proposed that that through the consummation intellectual property rights profession legislation, the establishment intellectual property rights value assessment and the investment system, enhances the intellectual property rights law enforcement dynamics, the enterprise to set up ways and so on.It is right to guide our country to use FDI and make the pattern transformation, enhances our country independent innovation ability.
