Since the Mid 20th after the 2th world war,the new international trade system has been established under the advocation of the GATT and its subsequent WTO which accelerate the process of the globalization of economy. With the development of integration of economy and technology, the protection of intellectual property rights (IPR) are striding towards internationalization and becomes increasingly important. IPR-related trade is undergoing a fast development which becomes more faster than the visible trading. Developed countries bring IPR agreement into the international trade and finally promoted the form of TRIPS Agreement. As a member of WTO, China should comply with the rules of WTO and its related agreements when embarking upon foreign trade and international competition. On one hand, we must acknowledge the positive impacts of TRIPS on China's foreign trade. A higher standard in IPR protection can encourage our invention ,our own creativity, our technology in products attracting more foreign investment and makes our products more competitive in the international market. In the other hand, we realize that China's law on IPR protection still has some disadvantages compared with international treaty. We should make an great effort to carry out the strategy of IPR protection to make our enterprises have more attention on IPR protection and make a good use of IPR to maintain our advantage of competition.This article firstly gives an introduction of Intellectual Property Rights, then analyses the implication of IPR protection in China's foreign trade and the impacts of TRIPS on China foreign trade. Last, from the view of China's enterprises who are facing with the severe competition with some foreign multinationals, I give my suggestions of China's IPR protection based on China's present IPR protection.
