The Construction Of Chinese Enterprises' Social Responsibilities

The traditional corporate theory believes that the only obligation of a company is to purse the maximum interests for the shareholders. However, the dominative position of this theory has been challenged by the proposition of"Enterprises'Social Responsibilities"which rose in the early of 20th century. The"Enterprises'Social Responsibilities"theory which is for the sake of the social interests and subject to the respect for the maximum interests of the shareholders, advocates that the company should take corresponding responsibilities for the relevant interest bodies besides the shareholders.With the high developing speed of Chinese economy, Chinese enterprises have got great achievements on business. However, the unilateral pursuit of economic interests has resulted in a great deal of social problems such as some companies damaged the legal rights of the employers and violated the consumers'rights, and many entities are lack of true and faith, be defaulted maliciously, be bankrupt in order to avoid liabilities and disclose fake information etc. Some entities even pollutes and damages the environment badly only for the sake of greater benefits and they are not willing to invest in environmental protection at all. The human beings taste the consequence of environment pollution besides the enjoyment of the loaves and fishes brought by the industrial development. The situation for the environment protection is serious.The huge payment of the social cost and expense is because of the lack of enterprises'social responsibilities besides the influence of the developing strategy and mode. There is no sustainable development without the environment that we relied upon. More attention should be paid to the environment and vulnerable groups in order to establish the society, which is resource saving and people can live in amity with the environment. We should insist in the scientific concept of development but not only attach importance to the economic effects. The performance of the enterprises'social responsibilities is not only based on the number of occupations that the entities provided or the taxes they paid, but also shall include the insistence about true and faith, law-abiding, the protection of the relevant bodies'interests and the obligation to the resource and environment.This essay disclosed the developing direction of the enterprises'social responsibilities through the study of its history and academic foundation and described the current situation of Chinese enterprises'social responsibilities through the comparison of legislate practice between the Orient and the Occident. The reason for the absence of Chinese enterprises'social responsibilities is that there is no legal system to standardize the enterprises'social responsibilities system and many entities just stare in their self economic interests while pay no attention to the social responsibilities. Also, there is no effective supervising method or approach to force the companies to take such social responsibilities. In the light of such situation, the construction of Chinese enterprises'social responsibilities shall be done by the government, enterprises and society together and shall combine the guide of the government, the self-restraint of the enterprises and the compulsion by the law together, besides the establishment of supervising system and punishing system. The construction of Chinese enterprises'social responsibilities system shall focus on the environmental responsibilities.
