Studies On The Effectiveness Of WTO Dispute Settlement Mechanism

This dissertation concentrated on the effectiveness of WTO Dispute Settlement Mechanism. Through studies, the effectiveness of WTO Dispute Settlement Mechanism can be evaluated fairly, and people's knowledge on the WTO Dispute Settlement Mechanism can be increased. The problems of WTO Dispute Settlement Mechanism can be also explored, and feasible suggestions to improve it can be made. Meanwhile, our government can be provided with suggestions about how to use WTO Dispute Settlement Mechanism.In order to evaluate the effectiveness of WTO Dispute Settlement Mechanism, three indicators were introduced. One is whether the goal to design the WTO Dispute Settlement Mechanism is reached, the other two are whether trade dispute can be settled through WTO DSM and whether the settlement is done in the given time period stipulated by the DSU. To do this research, method of statistics was applied. And the conclusion is that as a whole WTO DSM reached its goal, and provided the WTO with the necessary security and predictability. But it is not perfect. It can only deal with some disputes and can't settle them as quickly as possible.Why didn't the WTO Dispute Settlement Mechanism function as imaging? First, the power also functions in the international commercial intercourse. Second, the clash of WTO DSM'natures were found to be responsible for the less effectiveness of WTO DSM. Third, the economic interest zero-sum game of trade disputes and the politicization of trade problems also block the WTO DSM to function well. Thus the paper provides some feasible suggestions to improve its effectiveness.Now China is the third giant of world trade. Normally, the number of trade disputes and the scale of trade amount have the right correlation. The number of trade disputes about Chinese product is large and is growing quickly. China suffered much. So using WTO DSM to deal with trade dispute is a good choice for our government. This dissertation gave our government the advices such as to correct its attitude to WTO DSM and to set up special organization to deal with trade disputes.
