On The Export Credit Insurance System

In the progress of globalization, great achievements have been accomplished in our country, China integrates into international economy further, but the great changes have taken place in this area, because the wide use of D/P, D/A and some way familiar with it take place of L/C, great changes have taken place .especially with the entrance into WTO, we must amend a set of rules about hortative of international trade. Export credit insurance gains more and more attention of people.It is well known, the modern market economy is legal economy. in the international trade, in the international trade , the exporter faces a bigger risk, for example, the buyer goes bankrupt ,refuse to accept, is behind in payment and faces the political risk which cannot controlled. If not be reduced risk through the certain mechanism, which affect the exporter the enthusiasm and economical development. in order to reduce the risk, we must establish some certain mechanism ,it's nor enough for the exporter to do.The next part is the principal about the legal system. Because export credit insurance is a special kind of insurance, it still follow some principals, for example, the principle of utmost good faith, the principle of insured interest, the principle of proximate cause, the principle of subrogation. I also list these especially principal. By comparison, I believe that, from this principle, we know the basic rules we must follow.Compare to the USA and UK, the history of Chinese export credit insurance is very short, which can not meet the satisfy of the international trade. In this paper, I analysis the legal system of export credit insurance in USA and UK, UK and the USA has the biggest insurance market. UK is the country which creates it earliest. THE USA has the maturest market. So I study the two countries. Analysis the legal system of export credit insurance service trend of development specially including: export credit insurance services privatization; export credit Insurance Corporation international; export credit Insurance Corporation of business diversification and under writing projects enlarge the scope of inspection.Then I have a comprehensive introduction about our country .there are some advantage about our legal system, but still huge defection can be found. I list it in detail.
