The Initiative Probing Into The Chinese Rural-urban Industrial Injury Almsgiving System

The Labor Law of People's Republic of China (hereinafter called The Labor Law), which was implemented on January 1^st, 1995 is the basic law of labor law system in China. According to The Labor Law, social insurance is one of the basic rights that the labors possess, which includes five types of insurance: endowment insurance, unemployment insurance, medical insurance, industrial injury insurance and maternity insurance. Industrial injury insurance is one of the earliest and most widely-implemented insurance, and it is established in most countries with priority.Most of the migrants live on their physical force, thus they encounter the industrial injury most frequently. The Industrial Injury Insurance Ordinance made by State Department designs the industrial injury insurance system, and stipulates every employer should buy the industrial injury insurance for his employees including rural-urban migrants. Joining the industrial injury insurance is the nuclear contents of the industrial injury almsgiving system. Industrial injury insurance system is important to safeguard the proper rights of the labors, disperse the risk of shouldering the labor injury for employers, propel the safe production and maintain social stability.The thesis traces back the history of industrial injury almsgiving system for rural-urban migrants in China by using the research methods of literature, investigation, comparison, structure and demonstration. Then the thesis explores deep into the three problems in industrial injury almsgiving system, i.e, low rate of the coverage of social insurance among migrants; imperfect supporting mechanism and improper supervision procedure. Meanwhile, the thesis proposes improvement measures with the combination of the successful experience and the author's ideas, i.e, to spread the rural-urban migrants industrial injury insurance system widely; utilize the system of industrial injury insurance fund's priority in payment; establish and perfect the supporting mechanism of rural-urban migrants industrial injury almsgiving system; predigest the supervision procedure of rural-urban migrants industrial injury almsgiving system.
