Study On The State Land Supervision System In China

Since embarked on reform and the opening up policy, China reaches rapid industrialization and urbanization. However, the present condition of few land but big population has made the contradiction between economic development and cultivated land protection became highlighted. With the accelerated process of economic development, new forms of illegal using land appear, the most prominent is the excessive development zones, a larger number of cultivated land was occupied. In order to achieve short-term economic progress, some local governments attract investment with low prices; run various development zones and industrial parks under wrong approach of economic development, causing a large number of cultivated land was occupied, a large number of idle land was wasted, bring many social contradictions. The most important reason of the problems above is the land management and land use cases have not been effective supervised, the government has in fact been illegally using land. Therefore, in order to achieve the effective land use and land management supervision between the central and local governments, promote local governments to use land in a right and legal way, to build and implement the State Land Supervision System is particularly important.This paper draws on the research related to the State Land Supervise System, analyses the connotation and the present condition of implementation of the State Land Supervise System, points out that the existing problems are mainly manifested in the lack of legal support, supervising performance and inspection work of the extent of publicity needs to be raised, and so on. Base on the analysis of related factors of the State Land Supervise System, including socio-political civilization, the market level of economic development, legal system, penal system, this paper protects the future of the system, makes some related proposals in the content system, the implementation system and the protection system. This paper has a positive reference to the research of China's land supervision and administration supervision, also has a positive reference to the local government and land supervision departments' related work.
