Research On Land Supervision And Supervision In Shenzhen City

Land is the most fundamental material base of human living and development since ancient times. Since human society formation, land was given with resources and property, and the social group or state system in different history of the world always keep focusing on the right and the utilization method of land. In our country, the land problem always is the fundamental issue in relation to national strategy and overall situation, and almost each revolution of land will push the revolution of history forward. In case the land and the system of land plan are unable to meet the relevant interest demand, then illegal activities such as illegal using land and not follow the land plan etc will happen. After reform and opening in our country, with the rapid development of urbanization, more and more illegal activities above happen.Shenzhen in order to strengthen the land planning and supervision, standardize the behaviour of landplanning and supervision, guarantee the implementation of urbanization planning, and protect land resources, In 2010, Shenzhen set up urban planning and land resource commission, and to take charge of the implementation of land planning and supervision work in whole city, and three branches under the commission as following:the bureau of land planning and supervision, the detachment of land planning and supervision, and the leading group office for the investigation and dealing with illegal construction. In order to improve land planning and the supervision work better, Shenzhen NPC(people’s congresses) and government released a series of relevant law and regulation to ensure the implementation will be better and comply with the law and regulation of land planning and supervision. In the end of 2013, according to the basic principle of law and administrative regulation, combining the practice experience of land planning and supervision and considering future development of Shenzhen special economic zone(hereinafter refer to as "special zone"), Shenzhen NPC revised the rule of land planning and supervision which released in 1995, and the new rule comes into effect since 01 March 2014. As special zone of first try and the background of increasing land disputes, Shenzhen worked out the new rule, and has played a positive role in regulating land management, pushing the urbanization process and promoting the scientific and efficient development with eco-environment in city.To be fair, there are some problems in the running process of the rule of land planning and supervision, for instance, supervision system is unscientific, supervision regulation is not perfect and the quality of inspection team is not very well etc, these problems caused by both the reason of history and reality. For these problems, this article propose countermeasure and suggestion in six parts as following:reforming land planning and supervision system, improving land planning and supervision regulation, optimizing land planning and supervision system, dealing with remaining land planning issue, strengthening publicity for land planning and supervision regulation, enhancing the quality of inspection team.The innovation of this article is embodied in three parts as below:1, In the database of CNKI, author found that there are only five articles regarding Shenzhen land planning and supervision until the end of Sep of 2015, furthermore that most are news without deep and systematic analysis.2, This article stated the revision and improvement process for the rule of land planning and supervision in Special Zone, and reveal the relevant regulation of land planning and supervision should be revised and improved accordingly with the social and economy development. The application value of this academic viewpoint will be more fit into current policy.3, Based on the network platform of Shenzhen city "Heaven and earth net" for land planning and supervision, combining Shenzhen current situation, this article propose countermeasure and suggestion in different aspects for the improvement of Shenzhen land planning and supervision, including the system, the regulation, the mechanism and the quality of inspection team etc, it comes with important guiding function in working.
