Study On The System Of Public Bidding Of China Government Procurement

The system of public bidding for project has become the main form and central content of government acquisition all over the world because it has advantages such as program specification, just and transparency, high competitiveness, etc. However, this system is still in its start level in China and there exists some problems ask for prompt solution.This paper begins with the basic concepts of the public bidding system adopted by the government, pointing out that the system adopted by the government has guidance quality, marketability, administrative quality, social publicity and other qualities. It also points out that there is an essential difference between business acquisition and individual acquisition. So, emphasizing and strengthening the legal system and standard operation of the public bidding system has great importance on the protection of public interests and promotion on social equality and justice.The second part of this paper analyzes activities of government public bidding system by employing the hypothesis theory of economic man, pointing out that the related behavioral agents (purchasing agent, purchasing management department, executing department and bid evaluation specialists), who act as the sensible economic man, must has subjective awareness of profit in exercising the public power. So under the precondition of contempting system and emphasizing on civilization, combating corruption and building up a clean government can only be a wish. And by the analysis of rent-seeking theory, it points out that related behavioral agents (purchasing agent, purchasing management department, executing department and bid evaluation specialists), since they are in control of the rights of decision-making and monopoly, have rent-seeking behavior with suppliers or both sides are rent-seeking during several links of bidding or tendering, and that's the root of corruption in purchasing. By the analysis of proxy chaining during the whole bidding process using the theory of entrusted agent, it points out that moral corruption, corrupt activities and complicity are due to happen because of reasons such as information asymmetry and managerial opportunism etc., thus resulting in the malfunction of entrusted agent.In the third part, a brief introduction is given about the development of the public bidding system adopted by the government of Britain, America, Korea, Hong Kong and other countries. And by comparison from various aspects, we get much inspiration on respects of construction of the legal system, design on management system, implementation of effective supervision and promotion of e-procurement.In part four, on the basis of summarizing theory analysis and the practice in many countries, combining the development history of public bidding system in our country, it makes an analysis on problems such as the morbidity of current law system, unscientific organization structuring, unstandard bidding activity, incomplete management by supervision and lack of specialized purchasing personnel.In part five, it is pointed out that the fundamental solution to the problems above is to further perfect and optimize the development of law system on public bidding for purchasing project, establish as quickly as possible the details of the implementation of procurement law and its assorted measures and reinforce guidance and operative possibility of the bidding system; to adjust and standardize organization structuring, intensify working system of separation of purchasing and managing and to definite the job division among agents; to perfect the bidding system, disclosure all information, complete the compile of bidding document and management on bid evaluation specialists, to strengthen the inner operation management of collective purchasing organization, tighten the approval of intermediate body and to further standardize bidding behaviors; to establish a multi-tier supervisory and mediatory mechanism and reinforce inside and outside supervision; to establish system of admitting and eliminating employees, emphasize on the training of professional knowledge and education on professional ethics of employees; to build a uniform platform of e-procurement and carry out e-bidding to promote the application of information technology in every link of bidding.
