Being a product of China from timeshare, the property right hotel was introduced to China from the 90's of the 20th century and gets rapid development. However, for the lack of rational and effective institutions and mechanisms, the market of the property right hotel enters a state of disorder and confusion; and a variety of disputes related appear continuously which damage seriously the image of the property right hotel and pose a threat to the healthy development of the whole industry. Depth analysis of the factors to the property right hotel development and proposing targeted advices based on this have positive theoretical and practical significance for the healthy development of the property right hotel in China.Supported by the principles of the Institutional Economics and Economics of Regulation, the paper explores various factors to development of the property right hotel to form an organic whole with distinct levels and close structure, with synthetically using the methods of empirical and normative analysis and comparative and comprehensive analysis. On this basis, the paper reveals the necessity and urgency of the government to regulate the property right hotel market, and makes further specific suggestions to the government in order to overcome the difficulties and promote the development.Firstly, the paper introduces the theoretical foundation of property right hotel regulation. the paper defines and analyzes the concept and style of property right hotel, based on the definition of property and property right hotel, and compares with other related industry (such as timeshare) to further reveal the connotation of property right hotel, and define the scope of the study. On this basis, the paper summarizes the regulation theory related to property right hotel so as to lay a theoretical foundation for next research.Secondly, the paper makes a comprehensive analysis of the present status quo of our country's property right hotel from a development background, development process and the development pattern. The paper analyzes present situation of the foreign property right hotel development and makes a comparative study to propose the different in cultural values, level of industrialization and marketization, development model and the purpose of purchase and the challenges in development of that our country is facing in the process of property right hotel.Thirdly, the paper analyzes the factors to the property right hotel development from the angles of Economics of Regulation which are divided into internal factors, market factors, and institutional factors in three dimensions, thereby forms a theoretical system of clear-cut level and rigorous structure. The paper, from the basic principles of Economics, accentuates market failures such as the external problem and information asymmetry led by the unclear definition of property rights and so on. On this basis, this paper reveals the necessity and urgency of market regulation from the basic principles of Economics of Regulation, and further points out that the study of regulation is an important guarantee to promote sustainable development of property right hotel.Finally, on the basis of the above analysis, this paper has put forward specific regulatory response. First, we should establish a rational system of regulation, including strengthening the government supervision of the property right hotel, promoting the development of relevant industry associations, and supporting the development of profit-making organizations. Second, we should set the threshold to enter the hotel market and formulate the relevant polices and measures of product sales in order to establish a sound market system of the property right hotel. Third, through the improvement of legal regulation, fostering credit system, and the introduction of the third-party regulatory bodies, a perfect security system should be established.
